Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using ManyGPTS (the “Service”), operated at ManyGPTS.com, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”), together with our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.

These Terms constitute a legally binding agreement between you and ManyGPTS. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

ManyGPTS is a multi-model AI aggregation platform that provides a unified interface to access third-party artificial intelligence language models (“AI Models”). The Service includes, but is not limited to: chat with AI Models, model comparison, document-based chat, intelligent query routing, API access, and related features. ManyGPTS acts as an intermediary that routes your requests to third-party AI providers and returns their responses. ManyGPTS does not itself generate AI responses.

3. Eligibility

You must be at least 18 years of age to use this Service. By creating an account or using ManyGPTS, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. We reserve the right to request proof of age at any time and to terminate accounts where the User fails to meet this requirement.

4. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials, API tokens, and any associated authentication mechanisms.
• Accept full responsibility for all activities that occur under your account, whether or not authorized by you.
• Immediately notify us at support@manygpts.com of any unauthorized access to or use of your account.
• Not create multiple accounts for the purpose of circumventing usage limits, bans, or other restrictions.
• Not share, sell, transfer, lease, or sublicense your account to any third party.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, are being used fraudulently, or are in violation of these Terms.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

• Generate, solicit, or distribute content that promotes, glorifies, or instructs violence, terrorism, self-harm, or harm to others.
• Create, distribute, store, or solicit child sexual abuse material (CSAM) or any content depicting the sexual exploitation of minors.
• Generate instructions for manufacturing illegal weapons, explosives, controlled substances, or chemical/biological agents.
• Create, distribute, or deploy malware, ransomware, spyware, phishing tools, or any software designed for unauthorized access to computer systems.
• Engage in or facilitate harassment, stalking, doxxing, threats, or intimidation of any individual or group.
• Generate content that constitutes defamation, fraud, impersonation, or identity theft.
• Violate any applicable local, state, national, or international law, regulation, or ordinance.
• Attempt to bypass, circumvent, disable, or interfere with security features, content safety filters, rate limits, or usage restrictions of the Service.
• Use automated means (bots, scrapers, crawlers, scripts) to access the Service beyond the scope of the provided API, or in a manner that imposes an unreasonable load on our infrastructure.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service to build a competing product or service, or to systematically extract data for commercial purposes without authorization.
• Infringe upon the intellectual property rights, privacy rights, or any other rights of third parties.
• Transmit any material that contains viruses, worms, trojan horses, or other harmful code.
• Use the Service to generate spam, unsolicited communications, or misleading content at scale.
• Misrepresent AI-generated content as human-created in contexts where such disclosure is required by law or where doing so would constitute fraud.

Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your account, without prior notice or refund, and may be reported to appropriate law enforcement authorities where applicable.

6. Content Safety and Moderation

ManyGPTS implements automated content safety measures to detect, filter, and block harmful or prohibited content. These measures include pattern-based detection, escalation monitoring, and IP-based abuse prevention.

• Requests that trigger our safety filters will be blocked and may be logged for security review.
• Repeated attempts to bypass safety filters constitute a violation of these Terms and may result in account termination and IP blocking.
• We reserve the right to review flagged content and take appropriate action, including but not limited to account suspension, termination, and reporting to law enforcement.
• We continuously update our safety systems and reserve the right to modify content policies at any time without prior notice.

7. Subscriptions, Billing, and Payment

7.1 Subscription Tiers

ManyGPTS offers the following subscription tiers, subject to change:

• Free: 50 queries per month. Access to free-tier AI models. No payment required.
• Pro ($15/month): 2,000 queries per month. Access to all available AI models.
• Team ($45/month): 10,000 queries per month. API access. Priority support.

7.2 Payment Terms

All paid subscriptions are billed monthly in advance through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge recurring fees to your designated payment method. All prices are in US Dollars (USD) and are exclusive of applicable taxes, which you are responsible for paying. We reserve the right to modify pricing with 30 days' advance notice.

7.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

7.4 Usage Limits

Each subscription tier includes a monthly query limit. Unused queries do not roll over to the next billing period. If you reach your monthly limit, additional queries will be blocked until the next billing cycle or until you upgrade your plan.

8. Refund Policy

Due to the nature of digital services and the immediate availability of third-party AI model access upon payment, subscription fees are generally non-refundable. However, we may issue refunds at our sole discretion in the following limited circumstances:

• Service outage: The Service was completely unavailable for more than 72 consecutive hours during your billing period due to causes within our control.
• Billing error: You were charged in error (e.g., duplicate charges, charges after confirmed cancellation).
• Cooling-off period: You cancel within 48 hours of your first-ever subscription payment and have used fewer than 10 queries during that period.

Refund requests must be submitted within 30 days of the charge to support@manygpts.com. Chargebacks initiated without first contacting us may result in account termination. Refunds, if approved, will be processed to the original payment method within 5-10 business days.

9. API Access

Team-tier users may access ManyGPTS via our Application Programming Interface (API). API access is subject to the following additional terms:

• API tokens are confidential credentials and must not be shared, published, or embedded in client-side code.
• API usage is subject to the same rate limits, content safety policies, and usage quotas as the web interface.
• We reserve the right to revoke API access immediately for misuse, abuse, or violation of these Terms.
• API access may be subject to additional rate limits beyond your subscription quota to protect system stability.
• We do not guarantee specific API response times, uptime, or availability.

10. Bring Your Own Key (BYOK)

You may optionally provide your own API keys for third-party AI providers. By doing so, you acknowledge and agree that:

• Your keys are encrypted (AES-256-GCM) before storage and are only decrypted in memory during API calls.
• You are solely responsible for any charges, fees, or costs incurred through the use of your own API keys.
• You are responsible for ensuring your use of third-party APIs complies with their respective terms of service.
• ManyGPTS is not liable for any unauthorized use, data loss, service disruption, financial loss, or other damages arising from the use of your own API keys.
• You may revoke your keys at any time through your account settings.

11. Third-Party AI Providers and Services

ManyGPTS routes your requests to third-party AI providers including, but not limited to: OpenAI, Anthropic, Google (Gemini), xAI (Grok), DeepSeek, Groq, Mistral, Perplexity, Cohere, Together AI, Moonshot (Kimi), and Hugging Face.

• We do not control, endorse, or assume responsibility for the content, accuracy, completeness, reliability, or quality of responses generated by third-party AI Models.
• Each provider operates under its own terms of service and privacy policy, which you should review.
• Third-party providers may change, restrict, or discontinue their services at any time, which may affect the availability of certain models through ManyGPTS.
• We are not responsible for any data processing performed by third-party providers on your messages.

12. AI Output Disclaimer

AI-generated responses are provided for informational purposes only and should not be relied upon as professional advice. Specifically:

• AI outputs may be inaccurate, incomplete, outdated, biased, or misleading. They are not guaranteed to be correct.
• AI outputs do not constitute medical, legal, financial, tax, investment, or professional advice of any kind.
• You should independently verify any AI-generated information before making decisions based on it, particularly for health, safety, legal, or financial matters.
• ManyGPTS is not responsible for any actions taken based on AI-generated content, and you assume all risk associated with such reliance.
• AI outputs may generate content that is offensive, inappropriate, or objectionable despite our safety measures. We are not liable for such outputs.

13. Intellectual Property

13.1 Your Content

You retain ownership of the content you input into ManyGPTS (“User Content”). By submitting User Content, you grant ManyGPTS a limited, non-exclusive, worldwide license to process, transmit, and store your content solely for the purpose of providing the Service. This license terminates when you delete your content or account.

13.2 AI-Generated Content

Ownership and usage rights of AI-generated content are subject to the terms of the underlying AI provider that generated the response. ManyGPTS makes no representations regarding your ownership rights to AI-generated content and disclaims all liability related to intellectual property claims arising from such content.

13.3 Our Intellectual Property

The ManyGPTS platform, including its design, user interface, code, algorithms, branding, logos, trademarks, and documentation, is our proprietary intellectual property and is protected by applicable copyright, trademark, and other intellectual property laws. No part of the Service may be copied, reproduced, distributed, modified, or used to create derivative works without our express written permission.

14. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the Service, you consent to data practices described in the Privacy Policy. We implement industry-standard security measures, but no system is completely secure, and we cannot guarantee absolute security of your data.

15. Service Availability and Modifications

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted, error-free, or continuous access. We reserve the right to:

• Modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice.
• Perform scheduled or emergency maintenance that may temporarily affect availability.
• Add, remove, or change supported AI Models and providers.
• Modify pricing, quotas, rate limits, or feature availability with reasonable notice.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Termination

16.1 Termination by You

You may terminate your account at any time by deleting it through your account settings or by contacting us at support@manygpts.com. If you have an active paid subscription, cancellation will take effect at the end of your current billing period.

16.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms, including the Acceptable Use Policy.
• Repeated attempts to bypass content safety filters.
• Suspected fraudulent, abusive, or illegal activity.
• Non-payment of subscription fees.
• Inactivity for a period exceeding 12 months.
• As required by law or in response to a valid legal request.

16.3 Effect of Termination

Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your account data within 30 days, except data we are required to retain by law; (c) no refund will be issued for any prepaid fees unless required by law; (d) provisions of these Terms that by their nature should survive termination shall survive, including Sections 8, 12, 13, 17, 18, 19, 20, and 21.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY AI-GENERATED CONTENT DELIVERED THROUGH THE SERVICE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MANYGPTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; COST OF PROCUREMENT OF SUBSTITUTE SERVICES; PERSONAL INJURY OR PROPERTY DAMAGE; OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00). THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

19. Indemnification

You agree to indemnify, defend, and hold harmless ManyGPTS, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or any activity under your account.
• Your violation of these Terms or any applicable law or regulation.
• Your User Content or any content you generate using the Service.
• Your infringement of any intellectual property or other right of any third party.
• Any claim by a third party arising from your use of AI-generated content.
• Your use of your own API keys (BYOK) and any resulting charges or liabilities.

20. Dispute Resolution

20.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@manygpts.com. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within this period, either party may proceed with formal dispute resolution.

20.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding arbitration. The arbitration shall be conducted on an individual basis — class actions and class arbitrations are not permitted (see Section 20.3).

20.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

20.4 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

21. General Provisions

21.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

21.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

21.3 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and ManyGPTS with respect to the subject matter hereof and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

21.4 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

21.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

21.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet outages, or third-party service provider failures.

21.7 Notices

We may provide notices to you through the Service interface, via email to the address associated with your account, or by posting on our website. You are responsible for ensuring your contact information remains current.

22. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified at least 30 days in advance through email or a prominent notice on the Service. Non-material changes may take effect immediately upon posting. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree with the modified Terms, you must discontinue use of the Service and delete your account.
